Terms of Service

1. Acceptance of Terms

By accessing or using DealerService.ai ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a dealership, you represent that you have authority to bind that dealership to these Terms.

2. The Service

DealerService.ai provides a platform that allows authorized dealership personnel (Service Advisors, Managers, etc.) to:

• Create and send vehicle repair estimates to customers via SMS and email
• Allow customers to review, approve, or deny repairs electronically
• Maintain a digital audit trail of customer approvals

3. User Accounts

• You must create an account to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• Only authorized dealership employees may use the Service.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Customer Approvals & Electronic Signatures

• Customer approvals (via passcode-protected links) constitute a valid electronic authorization for the dealership to perform the listed repairs at the stated prices.
• You acknowledge that electronic approvals create a binding record between the dealership and the customer.
• It is your responsibility to communicate the 4-digit passcode securely to the customer.

5. Billing and Subscriptions

• Fees are billed according to the plan you select.
• Subscriptions automatically renew unless canceled.
• All payments are non-refundable except as required by law.
• We may change pricing with notice.

6. Acceptable Use

You agree not to:

• Send spam, misleading, or fraudulent estimates
• Use the Service to harass customers or violate TCPA / CAN-SPAM laws
• Attempt to access data of other dealerships
• Reverse engineer or attempt to compromise the security of the Service

7. Data Ownership & Processing

• You (the dealership) own your customer and estimate data.
• You grant us a limited license to process this data solely to provide the Service.
• We act as a data processor. Our Data Processing Addendum is incorporated into these Terms.

9. No Warranty

The Service is provided "as is" without warranties of any kind. We do not guarantee 100% uptime or error-free operation.

10. Termination

We may terminate or suspend your account for violation of these Terms. You may cancel your subscription at any time.

11. Governing Law

These Terms are governed by the laws of the State of South Dakota, without regard to conflict of laws principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
